Google Files Lawsuit Against Scammers Peddling Fake AI Chatbot, Bard, to Distribute Malware
In a move to combat cybercriminals exploiting its artificial-intelligence chatbot Bard, Google has initiated legal action against anonymous individuals in a California federal court. The tech giant alleges that these scammers are marketing deceptive “downloads” of Bard, using names like “Google AI” and “AIGoogleBard,” with the intent of installing malware on victims’ computers.
According to Google, the perpetrators are leveraging its trademarks to lure users into downloading the malware, which, once installed, enables them to pilfer social-media login credentials. The company identifies the defendants as Does 1-3 in the filed complaint, and Google’s general counsel, Halimah DeLaine Prado, stated that these scammers have “misled numerous people around the world.” Google has taken action by filing nearly 300 takedown requests associated with this scheme.
DeLaine Prado emphasized the efficacy of such lawsuits in establishing legal precedents, disrupting the tools used by scammers, and intensifying the consequences for bad actors. As technology companies, including Google, race to integrate artificial intelligence into their products, incidents like these underscore the challenges posed by cyber threats.

The lawsuit outlines the scammers’ tactics, detailing how they employ social media posts and web pages to advertise free downloads of Bard, despite the fact that Bard is not actually available for download. The malware, downloaded by unsuspecting victims, is then utilized to seize control of their social media accounts. The scheme has reportedly targeted various entities, including small businesses and Facebook advertisers.
Google has accused the defendants of violating its terms of service by impersonating the company and hosting the malware on Google Sites and Google Drive. The tech giant is seeking court intervention to block the scam and has requested the scammers’ profits along with other monetary damages.
The case, identified as Google LLC v. Does 1-3, is currently in the U.S. District Court for the Northern District of California with case number 5:23-cv-05823.
